Best Tutors - Terms of Service

Terms of Use

Definitions:

• The term 'Best Tutors' or 'us' or 'we' refers to the owner and operator of the platform.
• The term 'Platform' refers to the Best Tutors tutoring matching service, including all sub-domains and associated services.
• The term 'you' or 'users' refers to the users or viewers of the Platform, including both students and tutors.

Acceptance of Terms

The use of this Platform is subject to the following terms of use:

• The content of the pages of this Platform is for your general information and use only. It is subject to change without notice.
• Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this Platform for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
• Your use of any information or materials on this Platform is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any services or information available through this Platform meet your specific requirements.

User Accounts and Responsibilities

Account Creation:

• Users must provide accurate and complete information during registration
• Users are responsible for maintaining the confidentiality of their account credentials
• Users must notify us immediately of any unauthorized use of their account
• Users must be at least 13 years old to use the platform (or 16 in the EU)

Tutor Responsibilities:

• Provide accurate qualifications and experience information
• Maintain professional conduct during all sessions
• Honor scheduled session times and provide adequate notice for cancellations
• Ensure all educational materials provided are either original or properly licensed

Student Responsibilities:

• Provide accurate academic information and learning goals
• Maintain respectful conduct during all sessions
• Provide adequate notice for session cancellations as per cancellation policy
• Complete payments for scheduled sessions in a timely manner

Session Booking and Payments

Booking Process:

• Students request sessions through the platform
• Tutors have 48 hours to accept or decline session requests
• Once accepted, sessions are confirmed and payment is processed

Payment Terms:

• All payments are processed securely through Stripe
• Platform fee of 15% is applied to all sessions
• Tutors receive payment minus platform fees after session completion
• Refunds are handled according to our cancellation policy

Cancellation Policy:

• Cancellations more than 24 hours before session: Full refund
• Cancellations less than 24 hours before session: 50% refund
• No-shows: No refund
• Tutor cancellations: Full refund to student

Intellectual Property

Platform Content:

• This Platform contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance, and graphics.
• Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.

User Content:

• When you submit content to the Platform, you grant Best Tutors a license to use, display, and distribute your content for platform functionality.
• You confirm and warrant that you have the required authority to grant the above license.
• Tutors retain intellectual property rights to their original teaching materials.

Prohibited Activities

Users are prohibited from:

• Sharing personal contact information to conduct sessions outside the platform
• Engaging in any form of harassment or inappropriate conduct
• Misrepresenting qualifications or experience
• Using the platform for any illegal or unauthorized purpose
• Attempting to circumvent the payment system
• Uploading or sharing copyrighted material without permission

Session Conduct and Safety

Code of Conduct:

• All sessions must be conducted professionally and respectfully
• Video sessions should take place in appropriate, well-lit environments
• Both tutors and students should dress appropriately for sessions
• Discrimination or harassment of any kind will not be tolerated

Safety Guidelines:

• Sessions may be recorded for quality and training purposes
• Users can report inappropriate behavior through our reporting system
• We reserve the right to suspend accounts for violations of conduct policies

Limitation of Liability

Best Tutors acts as a matching platform between students and tutors. We are not responsible for:

• The quality of tutoring services provided
• Academic outcomes or results
• Disputes between students and tutors
• Technical issues with third-party services (Microsoft Teams, Stripe, etc.)

Our total liability to you for all claims shall not exceed the total amount of fees you have paid to us in the past 6 months.

Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Platform will immediately cease.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.
